Understanding the Sheriff's Return of Non-Service
Under Rule 4 of the Uniform Rules of the High Court and Rule 9 of the Magistrates' Courts Rules, initial process (including combined summonses, provisional sentence summonses, divorce proceedings, and warrants of execution) must generally be served personally upon the defendant or respondent by the Sheriff of the Court.
However, when the Sheriff attends the address on the face of the summons and discovers the premises are vacant, the tenant moved six months ago, or the debtor has deliberately relocated, the Sheriff cannot effect service. Instead, they issue a Return of Non-Service (often accompanied by sheriff fees for the attempted service).
The Common Non-Service Return Wording:
- "Attempted service at [Address]. I was informed by current occupant Mrs. X that the defendant moved to an unknown location."
- "Premises found locked and abandoned. Neighbors state defendant absconded."
- "Premises demolished / Commercial complex under new tenancy."
- "Security at gate refuses access to complex; defendant will not answer intercom or telephone."
